Merchant Shipping Act 1958

Introduction to Merchant Shipping Act
- History of Indian Merchant Ships, MSA coming into existence, Various Articles in MSA, Various definitions and explanations,
Unit 2
Registry of the Ship
- Who can register, Procedure for registry of the ship, Documents required for registry, Interim Cert of registry, conversion of Interim to Permanent registry, cancellation of registry, Cert A and B
Unit 3
Certificate of competency and Employment on ship
- Issuances of COC, competency of the seafarers, Age for employment, Trimmers and strokers convention, Special provision with agreement of crew on Indian Ship
Unit 4
Disputes between Seaman and Employers
- Formation of Tribunal, dispute resolution by Tribunal, Tribunal hearing, Pendency of hearing
Unit 5
Official Logs
- Content of the official log, sample log copy, entries to be made, legality of the official log, record of entries
Unit 6
Survey of the ship
- Survey requirement, fees for survey, role of the surveyor, process and purpose of survey, issuances of cert of survey
Unit 7
Safety and Collision
- Safety and loadline convention, construction of the ship, collision regulations, prevention of collision, unseaworthy and unsafe ship
Unit 8
Special provisions as to ships other than Indian ships
- Issuance of LL cert to foreign vessel, Recognition of cert, Inspection and control of certificate, producing of cert to customs etc
Unit 9
Collision, accidents at sea and limitation of liability
- Division of loss in case of collision, damages for personal injury, right of contribution, duty of master to assist in collision
Unit 10
Cost of detention and Damages
- Liability of central Govt, liability of ship owner, cost calculation method, application to ship other than Indian ship
